Manufacturers and importers of tobacco products, electronic cigarettes, refill containers, liquids used in electronic cigarettes and herbal products intended for smoking are responsible for ensuring that products intended for commercial sale or other supply comply with the applicable provisions. Valvira engages in supervision to ensure that the above-mentioned products are legally compliant.
Manufacturers and importers must submit notifications and reports to Valvira on the products’ ingredients, additives and other characteristics, as well as sales volumes. Furthermore, cigarette manufacturers and importers must provide Valvira with a notification on emissions from cigarettes when smoked, as well as an account confirming that the cigarettes meet the fire safety requirements set by law. The emission measurements and burning behaviour of cigarettes must be verified by a laboratory approved by Valvira.
Valvira may prohibit the sale or other supply of a tobacco product, electronic cigarette, nicotine-containing liquid, nicotine-free liquid intended for vaporisation and herbal product for smoking, if the product is not in compliance with the provisions of the Tobacco Act or if notifications and information on the product that are statutory under the said Act have not been provided. To enforce its prohibition, Valvira may issue a notice of a conditional fine. Furthermore, Valvira may require that the illegal product be withdrawn from the market.
